1. Who We Are

Welcome to Upfrica Marketplace. Upfrica helps users buy, sell, source, and discover products locally, nationwide, and across supported markets.

When this policy refers to “Sellers”, “Service Providers”, “Buyers”, “Users”, “you”, or “your”, it means people or businesses using Upfrica to list, buy, sell, source, or communicate through the platform.

2. Upfrica Terms of Use

By creating an account or using Upfrica, you agree to use the platform lawfully, honestly, and safely. You must provide accurate account information and keep your login details secure.

Upfrica is a marketplace platform. Products may be listed by independent sellers unless clearly stated as Upfrica stock, Upfrica-managed stock, or Upfrica-verified fulfilment.

Upfrica may update, suspend, restrict, remove, or refuse access to listings, accounts, payments, messages, seller tools, or marketplace features where we believe this is necessary for safety, fraud prevention, policy compliance, legal compliance, or platform integrity.

2.1 Marketplace Rules

Users must not misuse Upfrica, interfere with the platform, attempt to bypass security, scrape data unlawfully, create fake accounts, submit misleading listings, abuse messaging, or use Upfrica to break the law.

Prices, availability, descriptions, delivery estimates, photos, product condition, and seller information must be truthful and kept up to date.

2.2 Seller Responsibilities

Sellers are responsible for accurate listings, lawful products, correct prices, truthful stock availability, safe fulfilment, communication with buyers, and compliance with Upfrica marketplace rules.

Sellers must not list prohibited, unsafe, counterfeit, stolen, restricted, misleading, or illegal items. Sellers must also ensure that any product claims, images, labels, ingredients, safety information, and delivery promises are accurate.

Where Upfrica requires a stock, safety, or compliance promise before listing or editing products, sellers must accept that promise truthfully before continuing.

2.3 Buyer Responsibilities

Buyers are responsible for checking product information, delivery details, availability, prices, return conditions, seller information, and checkout details before placing an order.

Buyers must not abuse refunds, submit false claims, harass sellers, attempt fraud, or use Upfrica messaging, checkout, or support systems for unlawful activity.

2.4 What Is Not Allowed on Upfrica

These are examples of goods, services, or content that are not allowed on Upfrica:

  • Weapons, guns, firearms, silencers, ammunition, explosives, fireworks, stun guns, BB or pellet guns.
  • Adult-only items, adult entertainment, sex toys, illicit services, prostitution or sex trafficking.
  • Exploitation or endangerment of minors, child exploitation or harmful content involving minors.
  • Hazardous materials, dangerous chemicals, toxins, unsafe substances, or dangerous pesticides.
  • Human parts, remains, blood, bone, medical waste, surrogacy services, sperm, or eggs.
  • Prescription drugs, controlled substances, illegal drugs, drug-taking equipment, or restricted medicines.
  • Alcohol, cigarettes, nicotine products, vapes, or related restricted goods.
  • Animals, animal parts, endangered species, ivory, or protected wildlife products.
  • False, deceptive, misleading, fraudulent, keyword-spam, or bait-and-switch listings.
  • Stolen property, blocked phones, altered serial-number items, burglary tools, or security tag removal items.
  • Counterfeit, fake, copied, pirated, trademark-infringing, or unauthorised branded goods.
  • Hate, discriminatory, threatening, abusive, obscene, defamatory, or malicious content.
  • Government documents, IDs, passports, birth certificates, police items, licences, or official papers.
  • Lottery, raffle, gambling items, slot machines, or gambling services.
  • Spam, pyramid schemes, network marketing abuse, unsolicited marketing, or bulk mailing lists.
  • Any item, service, or content that breaches the law, platform policy, or the legal rights of others.

4. Changes to These Terms

Upfrica may update these terms, privacy rules, copyright rules, cookie information, and marketplace policies from time to time. Continued use of Upfrica after updates means you accept the latest version.
